General Terms and Conditions of Use

This document sets out the Terms and Conditions for the use of the Online Booking and Ticketing Management Platform, hereinafter referred to as the “UCTour Platform” or “UCTour”, and the services that the University of Coimbra, hereinafter referred to as "UC," offers its customers.

These Terms and Conditions - which may be amended from time to time and should therefore be consulted regularly - apply to all of the services available online. By accessing, browsing and using the website or any of the features on the platform, hereinafter referred to as the "website", you acknowledge and agree that you have read, understood, and agreed to the Terms and Conditions set out below.

The website, its content, infrastructure and the online ticketing management and delivery service, as well as the management of the said platform, except for payment mechanisms and methods, provided herein and through UCTour are owned and operated by UC and made available for personal and/or commercial use only, subject to the Terms and Conditions set out below.

Definitions

In this document, various definitions are used. Their meanings are as follows:

“Purchase of Tickets” - operation through which the Private Client, Professional Client, School Client, UC Internal Group or Private Group, obtains a valid ticket to access the visiting spaces under the conditions stipulated on the ticket.

“Private Client” - refers to any natural person, aged 18 or older, or legal entity who purchases or intends to purchase tickets on the UCTour Platform.

“Professional Client” - refers to any natural person, aged 18 or over, or a legal entity who commercially conducts recreational, sporting or cultural activities, which are either open air or cultural tourism activities and have a touristic interest for the region in which they are conducted, as stipulated in the appendix to Decree-Law No. 108/2009 of 15 May, as amended by Decree-Law No. 95/2013 of 19 July and Decree-Law No. 186/2015 of 3 September, and who purchases or intends to purchase tickets on the UCTour Platform.

“School Client” - refers to any public or private educational institution, leisure organization, youth or senior citizen associations, scout groups, catechism groups, and others for the purpose of educating and developing the individual's cultural, social and cognitive knowledge.

“Account” - refers to the Individual account of each Private Client, Professional Client, School Client, UC Internal Group, Private Group, or Guide on the UCTour Platform.

“UC Internal Group” - refers to any group whose booking request is made by members of the UC community.

“Private Group” - refers to any group whose definition does not fit any of the other categories.

“Guide” refers to a Tourism Information Professional designated by the Professional Client to accompany groups organized by them, who is previously registered on the UCTour Platform. The document that regulates this registration can be found at: https://visit.uc.pt/en/s/clientes-profissionais

“Register” - refers to creating an account on the UCTour Platform.

“User” - refers to all of the following definitions described above: Private Client, Professional Client, School Client or UC Internal Group, Private Group, and Guide.

1. UCTour Platform Ownership and Management

1.1. The ticketing operation is carried out via the UCTour Platform, owned by UC, public higher education institution, registered in Portugal, with its registered office at Paço das Escolas [Palace of the Schools], 3004-531, Coimbra, Portugal and registered under the legal entity identification number 501 617 582, and can be contacted via email: turismo@uc.pt.

1.2. UC is also manages the UCTour Platform.

2. Obectives and scope of application

2.1. UC, via UCTour, provides access to its visiting spaces, presented on the platform as visitor programs, which are duly described and contain information on their respective prices and conditions.

2.2. Access to and use of the UCTour Platform and the purchase of online tickets constitutes full acceptance of the provisions of this document, the entirety of which will be referred to as the Terms, Terms and Conditions or Agreement. If you do not agree with these Terms and Conditions, you will not be able to use the UCTour Platform.

2.3. UC reserves the right to amend and provide additions to the Agreement at any time and without prior notice, posting new Terms and Conditions on the website.

2.4. UC reserves the right to modify the contents of UCTour without prior notice and without any limitation, and does not accept any responsibility for possible damages or liability resulting from the unavailability and/or continuity of the platform and the services it offers.

2.5. It is forbidden to sell, resell, hyperlink, use, copy, monitor, display, download or reproduce any content or information, software, products or services available on the website for any commercial or competitive purpose or activity without prior permission from UC.

3. Registration and user account

3.1. It is not possible to make any purchase or booking without prior registration on the UCTour Platform.

3.2. UC Internal Groups should use their UC Online Services access credentials.

3.3. Where possible, UC undertakes to alert the User to the existence of temporary or other restrictions to visits to the visiting spaces that fall under UC management.

3.4. The User must keep the password confidential and notify UC immediately if any unauthorized third party becomes aware of that password, if there is unauthorized use of their email address, or if there is any security breach, with or without their knowledge. UC will not be responsible if a person, to whom the password is disclosed, uses (and/or transacts through) the Internet services and website.

3.5. All accounts must be registered with a valid regularly accessed personal email address. Any accounts that have been registered with a third-party email address or a temporary email address may be terminated without prior notice. The User may be asked to revalidate their account if it is suspected that an invalid email address has been used.

3.6. UC may send emails to the User with information about activity on his/her account. Should the User wish to stop receiving commercial or promotional communications from UC, he/she may request the service to be terminated by sending an email to: turismo@uc.pt.

3.7. Each Professional Client shall appoint an administrator, who will be responsible for the management of the account. Once registration to the platform has been validated, no new registration will be possible. The account administrator may later add other users.

3.8. An institutional account will be created for the School Client. The various users who fall into this category should register on the page created for this purpose. Access credentials will be sent to the email address provided during the registration process.

3.9. UC reserves the right to cancel an account, should the User fail to respect the Agreement.

4. Contract

When purchasing tickets through the UCTour Platform, Users enter into a direct contractual relationship (distance contract) with UC through which they purchase tickets, based on the prior agreement (framework contract) entered into by that Private Client, Professional Client, School or Internal UC Group and UC.

5. Access to UC spaces

5.1. A valid ticket is required to access and visit UC visiting spaces. UC reserves the right for its staff to verify that visitors are in possession of the necessary and required documentation.

5.2. Tickets are valid for two days. With the exception of visits to the Baroque Library, the entrance dates and times for which are set when the ticket is purchased, the remaining spaces may be visited for a period of two days after the selected date.

5.3. Tickets purchased at reduced prices will generate a voucher that must be validated and exchanged on the day of visit at the first place you’re visiting.

5.4. Access to and permanence in the visiting spaces are subject to a set of rules presented on the platform.

5.5. Children under 16 years old will not be given entry unless they are accompanied by an adult.

5.6. Entry will be denied to visitors should tickets be purchased from entities outside UC (who do not have protocols in place), theft, counterfeiting, illegibility of the ticket (for which the visitor is responsible), copying or obtained in violation of this Agreement.

6. Specific visiting conditions for Tour Agents/Operators

6.1. Agency tickets can only be purchased with a minimum of 5 clients per booking;

6.2. The free ticket is only for the professional associated with the booking. If you are accompanied by an extra professional, the general rates will apply;

6.3. Visitors holding a private client ticket on a free basis do not have the possibility of being accompanied by a guide, nor do they have the possibility of explanations within the visiting areas;

6.4. The purchase of internal guided tour tickets from the Tourist Office is restricted to private customers.

7. Prices

7.1. Prices are displayed on the website in euros at the legal rate in effect, and the parties are bound by the price set in that currency.

7.2. Errors, omissions and misunderstandings (including misprints) are not binding on UC. In case of doubt, the services should be contacted to confirm information that appears to be a manifest error, omission or misunderstanding.

8. Payment arrangements and deadlines

8.1. Payment methods: The payment methods available on the UCTour platform are: Multibanco Reference (only available for Portuguese nationals), PayPal and Credit Card.

8.2. Payment deadlines: Payment must be made before the deadline indicated on the invoice, after which the sale will be automatically become redundant, and any payments made thereafter are invalid and will not result in a booking or ticketing.

9. Access to the UCTour Reserved Area

Access to this area is reserved for the Professional Client, who after registering and accepting the specific terms and conditions of use, may enjoy the special conditions intended for this client.

10. Returns and Refund Policy

10.1. UCTour has a no returns or refunds policy, with the exception of occasional closures of the Baroque Library;

10.2. The public will be informed of occasional closures to some other spaces via the website. These situations are not subject to reimbursement or discount on any tickets purchased, but users may visit at a different time, without affecting the provisions in 5.2 above.

11. Termination of the Contract

11.1. UC reserves the right to suspend or discontinue its service with the User, with immediate effect, should the User violate the rules in effect.

11.2. Either party may terminate this Agreement at any time by providing written notice.

12. Copyright Procedure and Policy

12.1. The contents of this website, such as images, text, advertising, audio content, including the website's own design and software are, if not otherwise stated by us, the sole property of UC, and as such are protected by copyright and related rights in accordance with the national and international legislation in effect.

12.2. It is forbidden to reproduce, distribute, copy, modify, download, present, or transmit any content on the website, in whole or in part, in any form or by any means, for the purposes of sale, rental, resale, licensing or sublicensing, use for the creation of derivative works, or any other means of exploitation without the express permission of UC or its owner, unless expressly provided the applicable legislation. If permitted, by law, to download, copy, redistribute, transmit, or publish this copyrighted material, this must be done by referencing the copyright material and not altering or deleting any mention of the author or commercial trademark reference. Any violation of these restrictions may result in the infringement of intellectual property rights (be it copyright, related rights, or industrial property rights) or trademark law, and which may result in civil and/or criminal proceedings. Furthermore, no use may be made of the content that exceeds or violates the scope of this Agreement.

12.3. The “University of Coimbra” brand, UC logos and variations thereof found on the website are distinctive signs owned by UC and any use of these will be for the User's benefit. Other trademarks on the website not owned by UC may be the property of their respective owners or may be licensed to UC by the trademark owner, in which case this license is for UC's sole benefit and use, unless otherwise stated. UC names, logos, trademarks, or other intellectual property rights may not be used without the express permission of UC.

12.4. Any material that is transmitted or posted on the website (or transmitted to UC) by any other means will be considered (and may be treated as) non-confidential and of immediate use, but subject to our obligations, under data protection legislation and subject to any payment details that the User provides for payment purposes.

13. Website Usage Rules

13.1. Interruption of Access: While we try to ensure uninterrupted access to the website, access to the website may be suspended, restricted or terminated at any time. The User's access to the website may be restricted from time to time to allow for repairs, maintenance, or the introduction of new features or services to the website. UC will attempt to restore access as soon as reasonably possible. It also reserves the right to block access and/or edit or remove any material that may give rise to the violation of any provision of this Agreement.

14. General Provisions

14.1. Applicable Law: This Agreement (and all relationships between the User and UC) will be governed by and interpreted in accordance with Portuguese legislation.

14.2. Relevant Court: Any dispute arising out of these General Terms and Conditions and our services will be submitted to the relevant courts in the District of Coimbra, Portugal.

14.3. Invalid Provisions: If any provision of these Terms and Conditions is or becomes invalid, unenforceable or non-binding, the User shall remain bound by all other provisions herein.

14.4. Integration: All matters concerning the rights and obligations of the parties not expressly governed by these Terms and Conditions are governed by the applicable special legislation, namely legislation governing the signing of remote contracts and the legislation protecting intellectual property.
